1. Introduction

Welcome to Mimosa Notary.

These Terms and Conditions ("Terms") are a legal agreement between you ("Customer" or "you") and Mimosa Notary.

2. Services

Our Commitment to You: At Mimosa Notary, we value your time as much as our own.

As a premium mobile service, our schedule is carefully managed to ensure we arrive on time and fully prepared for every client.

Mimosa Notary provides mobile notary public services, including but not limited to, general notarizations, estate planning document signings, and real estate loan signings. Our role is strictly limited to verifying identity and witnessing signatures as an impartial witness.

3. Appointment Information

You are responsible for providing accurate information regarding the signing location, number of documents, and the physical/mental capacity of the signers.

4. Fees and Payment.

Appointment Fees: Fees consist of the California statutory notary fee plus a travel/concierge fee.

Payment & Confirmation We are dedicated to providing services that save you valuable time, energy, and effort. Within 1–2 minutes of booking, you will receive a confirmation email with additional instructions. If you need to reschedule, you can easily do so using the links provided in that email.

Refund & Cancellation Policy We understand that life happens. If you choose to cancel your appointment:

Standard Cancellations: You are entitled to a refund of the service charge, minus a $50.00 administrative and scheduling fee.

Complimentary Rescheduling: We offer (2)-times complimentary rescheduling if you contact Mimosa Notary at least two hour prior to your appointment.

Late Cancellations: Cancellations made within one hour of the scheduled appointment time are not entitled to a refund.

Incomplete Signings: If a signing cannot be completed due to circumstances outside the Notary’s control (e.g., improper ID, unwilling signer), the fee is considered earned and is non-refundable.

The Mobile Arrival Window Given the time-sensitive nature of legal notarizations and the unpredictability of travel, please allow a 30 minute arrival window.

This grace period accounts for unpredictable traffic, hospital check-in delays, or signer availability. In the event your appointment is delayed beyond this window, you will be notified within 30 minutes of your original start time.

We make every attempt to arrive on time and have an outstanding record of delivering professional, punctual service.

5. Rescheduling Policy

We understand that plans can change.

To accommodate this, clients may reschedule their appointment up to two (2) times without additional charge.

Rescheduling must be requested at least two hours prior to the scheduled appointment time and must be due to circumstances outside of the notary’s control.

After two (2) reschedule requests, any additional changes will require a new booking and payment.

If the need to reschedule is due to an issue caused by the notary, the reschedule will be accommodated at no cost, and will not count toward the two (2) allowed reschedules.

Examples include, but are not limited to:

• Notary arrives more than 1 hour late
• Notary fails to appear
• Notary is unable to complete the appointment due to an internal error

All reschedule requests are subject to review.

Notary Discretion will be applied in determining eligibility for no-cost rescheduling based on the circumstances presented.

6. Integrity of the Documents

Clients agree to provide authentic, unaltered documents for notarization.

Any attempt to use Mimosa Notary for fraudulent or illegal purposes will result in the immediate termination of the session and may be reported to the appropriate authorities.

7. Data Protection

We respect your privacy. All documents and personal identification shared with Mimosa Notary are handled in strict accordance with California Notary Law and our secure Privacy Policy. We never sell or share your data.

8. Right to Refuse Service.

Mimosa Notary reserves the right to refuse or terminate service at any time if a signer appears to be under duress, lacks the required mental capacity to sign, or if the documents or identification provided appear fraudulent or non-compliant with California law.

9. Limitation of Liability

No Warranties: Mimosa Notary is provided on an "as-is" basis.

We do not make any warranties about the reliability, accuracy, or suitability of our services for your specific needs.

Liability Limitation: To the extent permitted by law, our total liability for any claims arising from or related to these Terms or Mimosa Notary’s services is limited to the amount you paid for the notary service fee.

10. Dispute Resolution

Governing Law: These Terms are governed by the laws of the state of California.

Arbitration:
Any disputes arising under these Terms will be resolved through binding arbitration in San Joaquin County, California.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of any significant changes through our website or by email.

Continued use of Mimosa Notary after such changes constitutes your acceptance of the updated Terms.

12. Mobile Service Protocols.

Wait Time Policy: A grace period of 15 minutes is included. After 15 minutes, a wait-time fee may apply.

Identification Requirements: The Customer is responsible for ensuring all signers have valid,

government-issued photo identification as required by California law.

13. Mobile Messaging Terms & Conditions

Program Description: Mimosa Notary provides mobile notary appointment reminders, scheduling updates, and logistics coordination via recurring text messages. By providing your mobile number and opting in, you agree to receive automated and manual text messages from Mimosa Notary.

1. Message Frequency: Message frequency varies based on your appointment activity and document needs.

2. Message & Data Rates: Message and data rates may apply for any messages sent to you from us and to us from you. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

3. Opt-Out Instructions: You can cancel the SMS service at any time. Just text "STOP" to our phone number. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us.

If you want to join again, just sign up as you did the first time.

4. Support Instructions: If you are experiencing issues with the messaging program you can reply with

the keyword HELP for more assistance, or you can get help directly at [email protected] or (209) 340-0048.

5. Carrier Liability: Carriers are not liable for delayed or undelivered messages.

6. Age Restriction: By signing up for Mimosa Notary text alerts, you represent that you are at least 18 years of age and have the legal capacity to agree to these Terms.
